1. Introduction

Welcome to Diamond Embellecers, a trading name of Thames Business Solutions Ltd, bespoke fine jewellery designers and retailers based in London.

These Terms and Conditions govern your use of our website and the purchase of any products or services from us. By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our website or purchasing from us.

2. Definitions

Throughout these Terms and Conditions:

"Diamond Embellecers", "we", "us", "our" refer to Thames Business Solutions Ltd T/A Diamond Embellecers, 62 Hatton Garden, London EC1N 8LR, registered in England and Wales (Company No. 09028338).
"Customer", "you", "your" refers to any individual or business purchasing goods or services from us.

"Goods" means jewellery, gemstones, precious metals, and any other products sold by us.
"Services" means jewellery design, repairs, valuations, resizing, cleaning, polishing, and related services.
"Order" means your request to purchase Goods or Services from us.

3. Use of Our Website

You may use our website for lawful personal and non-commercial purposes only.

You must not:

Use the website for any unlawful, fraudulent, or harmful activity.
Copy, reproduce, distribute, modify, or exploit any content without our written consent.

We reserve the right to suspend or terminate access to the website where these Terms have been breached.

Whilst we take reasonable steps to ensure that website information is accurate and up to date, we do not guarantee that all information will always be complete, accurate, or uninterrupted. Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.

4. Orders & Contract Formation

To place an order you must:

Be at least 18 years of age.
Have legal capacity to enter into a contract.
Provide accurate and complete information for billing, delivery and contact purposes.

When you place an order, you are making an offer to purchase Goods or Services.

Orders are subject to acceptance by us. A contract is formed only when we issue written confirmation via email or other written communication.

We reserve the right to refuse or cancel an order before dispatch where:

Goods are unavailable.
Payment cannot be authorised.
Pricing or product description errors occur.
Fraudulent activity is suspected.
Legal or regulatory requirements prevent fulfilment.

Where payment has already been taken for a cancelled order, a full refund will be issued.

5. Pricing & Payments

All prices displayed are inclusive of VAT where applicable.

Delivery charges, where applicable, will be shown during checkout before payment is completed.

Full payment is required before production, dispatch, or provision of Services unless otherwise agreed in writing.

We reserve the right to amend pricing at any time; however, confirmed orders will not be affected by subsequent price changes.

Where invoices remain unpaid beyond agreed payment terms, we reserve the right to charge interest at a rate of 4% per annum above the Bank of England base rate, where legally permitted.

6. Delivery & Collection

Delivery

We deliver throughout the United Kingdom using secure and insured delivery services.

Complimentary delivery is provided via Royal Mail Special Delivery, unless otherwise agreed.

All items are:

Fully insured during transit.
Securely packaged.
Discreetly labelled for privacy.
Presented in premium jewellery packaging.

Whilst estimated delivery times will be provided wherever possible, these times are estimates only and are not guaranteed.

Risk in the Goods passes to you upon successful delivery.

Customers may collect their order from:

Collection must be arranged in advance. Identification may be required before Goods are released.

Alternative Delivery Addresses

Orders may be delivered to an alternative address subject to additional security verification.

For payments made via:

PayPal
Apple Pay
Amazon Pay

delivery may be restricted to the verified billing address for fraud prevention purposes.

Urgent Orders

Where production schedules allow, expedited manufacturing may be available.

Additional charges may apply for priority production, particularly for:

Diamond-set jewellery
Halo settings
Trilogy rings
Vintage-style designs
Bespoke commissions

7. Ring Resizing

We appreciate that determining the correct ring size can be challenging.

Where eligible, we offer one complimentary ring resize within 30 days of receiving your order.

Certain styles cannot be resized, including but not limited to:

Full eternity rings
Certain bespoke designs
Designs with structural limitations

Where resizing is not possible, alternative solutions may be offered.

8. Product Information

As all fine jewellery is crafted from natural materials:

Gemstones and diamonds may exhibit natural variations in colour, clarity, cut and appearance.
Precious metals may display minor differences in finish or texture.
Product photographs are provided for illustrative purposes only.
Actual products may vary slightly due to screen settings, craftsmanship, and natural material characteristics.

Such variations do not constitute defects.

All precious metal jewellery will be hallmarked where required by the Hallmarking Act 1973.

9. Returns & Refunds

We hope you are delighted with your purchase. If not, you may be eligible to return eligible Goods within 14 days of receipt.

Returned Goods must:

Be unworn and unused.
Be returned in original packaging.
Include all certificates, tags and accessories.
Be accompanied by proof of purchase.

The following cannot be returned unless faulty or misdescribed:

Bespoke or custom-made jewellery.
Personalised or engraved items.
Made-to-order pieces.
Earrings, for hygiene reasons.

A Returns Authorisation Number (RAN) must be obtained before returning any item.

Refunds

Once returned Goods have been inspected and approved:

Refunds will be processed within 14 days.
Refunds will be made using the original payment method.
Standard delivery charges will be refunded where required by applicable consumer legislation.

Customers remain responsible for return postage costs unless the Goods are faulty, damaged, or incorrectly supplied.

This Returns Policy does not affect your statutory rights under consumer protection legislation.

10. Faulty or Damaged Goods

Customers are encouraged to inspect Goods promptly upon receipt.

If an item arrives damaged, defective, or not as described, please notify us as soon as reasonably possible.

Nothing within these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable consumer legislation.

11. Jewellery Services

We offer a range of specialist jewellery services including:

Bespoke design
Repairs
Resizing
Valuations
Cleaning and polishing
Restoration

Quotes and estimated completion times will be provided before work commences.

Unless otherwise agreed, customers remain responsible for the cost and risk of transporting jewellery to and from our premises.

12. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence.
Fraud or fraudulent misrepresentation.
Breach of statutory consumer rights.
Any liability that cannot lawfully be excluded.

Subject to the above, our total liability arising from any order shall not exceed the amount paid by the customer for the relevant Goods or Services.

Any personal data collected will be processed in accordance with:

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from circumstances beyond our reasonable control, including but not limited to:

Strikes
Transport disruptions
Government restrictions
Supply chain interruptions
Acts of terrorism or war

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
